Upper Cumberland Radio Control Society Bylaws

ARTICLE I: NAME, LOCATION, and INCORPORATION.
Section I- The name of the club shall be THE UPPER CUMBERLAND RADIO CONTROL SOCIETY. 

Section II- The principal location of the club will be Cookeville, TN.  

Section III- the Upper Cumberland Radio Control Society is a non-profit organization.

ARTICLE II: PURPOSE

The purpose of the club shall be to further the sport of model aviation by:

ARTICLE III: MEMBERSHIP

Section I- Any individual who indicates an interest in the building or flying of model aircraft or in furthering the purposes of the club or the AMA shall be eligible for membership. 

Section II- AMA membership is required for all flying members.  AMA membership is not required for non-flying members of the club. 

Section III- Membership fees are agreed upon and voted on by the club members on a yearly basis. 

Section IV- Membership fees are due January 1st and membership is valid thru December 31st for each calendar year.  Dues paid after October 1st will apply for the remainder of the current calendar year as well as the following calendar year. 

Section V- Membership will be revoked if a member does not abide by the rules and regulations of the club or exhibits unsafe flying habits.  The BOD will review the situation and recommend actions to the club.  The BOD recommendations will be voted on by the club membership and requires a majority vote for implementation. 

ARTICLE IV: OFFICERS

Section I- The elected officers of the club shall be: President, Vice- President, Secretary, and Treasurer. 

Section II- Only members in good standing shall hold office. 

Section III- An officer may hold more than one office at a time. 

Section IV- The period of office shall be the calendar year coinciding with membership. 

Section V- Officers will be installed immediately following their election.  

Section VI- President shall preside at meetings, VP shall preside in the absence of the president.  It is the duty of the Secretary/ Treasurer to keep accurate and up to date records of all financial and membership matters. 

Section VII- The Executive Board (EB) of the club shall be composed of all elected officials.  The Board of Directors (BOD) consists of the Executive Board and appointed officers. 

Section VIII- The executive board will appoint a Safety officer, Field Marshall, and other offices as deemed necessary.

ARTICLE V: MEETINGS

Section I- Meetings will be held once a month on a date set by the membership, unless agreed otherwise. 

Section II- Meetings will take place at any locale determined by the membership. 

ARTICLE VII: COMMITTEES

Section I- The Executive Officers may appoint committee’s as needed.

ARTICLE VIII: NOMINATIONS, ELECTIONS, AND RECALL

Section I- Only paid members are eligible for nomination to office. 

Section II- Nominations for club officers will be requested in the fourth quarter of each year. 

Section III- Any paid member may send in a written ballot if they are unable to attend the meeting that the elections take place at. 

Section IV- Elected positions are determined by a majority vote of members present at the election meeting (including any written ballots). 

ARTICLE IX : VOTING

Section I- All votes must have a majority of the club membership present for the vote to be considered a legal act of the club.  If a majority of the club is not present, the item may be debated and/or discussed, but the voting must be tabled until a later meeting or another method of voting may be enacted to allow for a legal vote to occur (i.e.- e-mailed ballots, etc). 

Section II- A majority is defined as 50.0% of the active club membership, as defined by the current club roster. 

ARTICLE X: EXPENDITURES

Section I-  Any club expenditure that is less than $250 is approvable at the Executive Board or authorized committee level (if that committee has an approved budget to be working from). 

Section II- Any club expenditure that is equal to or exceeds $250 in value must be voted on by the club membership for approval.  An item or project can not be broken up into “sub-projects” to avoid the voting requirement.  (For example- building a new shelter could NOT be broken up into 1) building a floor, 2)  installing posts for tent canopies, and then 3) building a permanent roof to keep each item below the $250 requirement.) 

ARTICLE XI: MISCELLANEOUS PROVISIONS

Section I- All records will be made available for club members viewing with prior notice. 

Section II- Each member by accepting membership agrees to abide by the “Official AMA Safety Code” and also the “Safety Recommendations” as currently installed and posted on the official AMA web site (www.modelaircraft.org). 

Section III- The “Fiscal Year” is defined as January 1st through December 31st. 

Section IV- The club has an official logo and no other logo or logo’s shall reference UCRCS.  The official club logo can be found on the club website. 

Section V- All standing rules posted at the flying field are to be followed at all times and are to be considered official.

ARTICLE XII: AMENDMENT OF THESE BYLAWS

Section I- All bylaw changes must be announced and made public two weeks prior to voting on said changes. 

ARTICLE XIII: GRIEVANCE PROCEDURE (FLIGHT AND SAFETY RULES)

The grievance procedure provides a mechanism to enforce existing safety rules by providing a progressive disciplinary system when needed. Although most complaints can be resolved informally, if a complaint is serious or cannot be resolved informally, the matter should be referred to the Safety Officer for their consideration by means of a Grievance Form to be filled out and turned into the Board of Directors. At least one witness is required to sign the Grievance Form

The Safety officer/Committee shall use its judgment in carrying out action on the following:

Section I- A grievance form will be filled out and turned into the Safety Officer/Committee Chairman. At least one witness is required. 

Section II- FIRST VIOLATION- Viewpoints of both complainants and accused will be considered. Complainant’s name will be disclosed. A verbal reprimand will be given to the accused by the Safety Officer/Board of Directors. This will be recorded in the Club records. 

Section III- SECOND VIOLATION- Complainant’s name will be disclosed. The accused has the right to a written rebuttal, to be reviewed by the Club Safety Officer/Board of Directors. If the Board of Directors so decides, the flying privileges of the accused will be suspended for thirty (30) days.  Written notice of this shall be issued and a copy published in the Club newsletter. 

Section IV- THIRD VIOLATION- Safety Officer/Board of Directors will notify the accused in writing and the Club members via the Club newsletter that the Club will vote on the expulsion of the accused at the next meeting. Said expulsion will last for a one-year minimum from the date of expulsion. A member may be expelled from the Club only upon a two -thirds (2/3) majority vote of the membership present at the meeting. Voting will be by secret ballot at a regular monthly meeting. The expelled member may reapply for membership after the expiration of the expulsion time period.

Section V- The three actions will not be enforced unless they are accumulated within a two-year period of time. 

Section VI- Any member receiving a Grievance, who directs any retaliation action against the person filing said grievance, will be subject to immediate expulsion from the Club. This is to include threats, intimidation, physical harm, intentional equipment damage, or any other action deemed to be retaliatory by the Club Officers.
